The Michigan Court of Appeals has decided that worker’s compensation lump sum back payments are marital assets to the extent they were accrued during the marriage.Cunningham v. Cunningham, 289 Mich App 189; 795 NW2d 826 (2010)

DIVORCE AND WORKER’S COMPENSATION PAYMENTS IN THE FUTURE

The Michigan Court of Appeals has decided that future worker’s compensation benefits are NOT marital assets to be divided in a divorce.  Cunningham v. Cunningham, 289 Mich App 189; 795 NW2d 826 (2010)  Future payments are considered in a claim for spousal support.
