Do I Need an Attorney for a Divorce?
Do I need an Attorney for a Divorce? The answer to the question depends on a number of factors.
How capable are you?
If you are a very capable person. If you are willing to put in the extra effort to do research and prepare paperwork correctly, then you may be in a position to complete your own divorce. To complete a divorce correctly, you need to take the time to ensure that you understand what you are doing and that you have covered all the assets and debts in your judgment. You also have to ensure that you have covered all issues that may arise after our divorce. A small mistake could result in an error that you cannot fix or that you will spend thousands to fix.
How complex are your assets?
If you have complex assets and debts or assets that have tax complications, then you are better off with an attorney. Again, a small mistake could cost thousands. A simple divorce where there are no disputes is not expense with an attorney. Typically 2,000 or so.
How much time do you have?
Doing your own divorce yourself the right way will take time. The paperwork must be correct. the court staff will not do your documents for you. Additionally, you will need to take the time to set-up the hearings and court time yourself. The court will not do it for you. I will take about 15 hours or so \of work for someone who is not experienced in divorce. Do you want to take the time necessary to do it right? A skilled layer can complete a basic divorce in less time with a guarantee that it is done right. You also have someone who you can ask questions.
Overall, anyone has a right to complete a divorce by themselves. The question you need to ask is – do I want to ask the time and effort to do it right? or hire someone who knows what they are doing?
